Burkina Faso (formerly known as Upper Volta; French: Haute Volta) is a landlocked country located in the middle of West Africa’s “hump.” The northern part lies geographically in the Sahel zone, the transition zone between the Sahara Desert in north and the tropical savanna in south. Burkina’s landscape offers one major scenario, flat, with some rocky cliffs in Centre-Nord region and at the Banfora Escarpment arround Bobo-Dioulasso, the country’s second largest city.

The country sits on an extensive plateau, it is bordered by Mali in north and north west, by Niger in north east, by Benin in south east and by Cote d’Ivoire, Ghana, and Togo in south. Burkina covers an area of 274,222 km², this is about three times the size of Austria, or slightly larger than the U.S. state of Colorado.

Overtime

Every hour worked beyond the weekly legal limit of hours of work or time equivalent is compensated as follows:

  • 15% of compensation for each of the first 8 hours worked after the 40th hour, or equivalent time;
  • 35% of compensation for each hour worked after the 48th hour, or equivalent time;
  • 50% of compensation for each hour worked during the night in ordinary days;
  • 60% of compensation for each hour worked on Sundays or Holidays;
  • 120% of compensation for each hour worked during the night on Sundays or holidays.

Vacation leave in Burkina Faso

An employee is entitled to 22 working days of annual leave after completion of 12 months of service with an employer. The employee has a right to a paid leave chargeable to the employer, at the rate of two and a half calendar days (30 calendar days) per month of effective service unless more favourable provisions are found in a collective agreement or individual employment contract. For the calculation of the duration of the leave acquired, the absences due to accidents at work or professional illness, the legal periods of rest for pregnant women, the periods of compulsory military service, not even to the limit of one year, illness duly attested by a medical certificate and exceptional permissions, are not deducted from the leave. The duration of the leave is increased at the rate of two working days after 20 years of continuous service, four working days after 25 years and six working days after 30 years.

Sick leave

A worker’s rights to work and income should be protected when illness strikes. The national labour law may provide that sickness benefit may not be paid during the first 3 days of your absence. Minimally, a worker should be entitled to an income during first 6 months of illness. This income should be at least 45 per cent of the minimum wage. (Countries are free to opt for a system which guarantees 60 per cent of the last wages during the first 6 months of illness or even during the first year).

The total maternity leave should last at least 14 weeks.

Burkina Faso Severance Laws

Termination of employment must be made in writing and include the reason for termination. Notice of termination must be given: 8 days for hourly workers, one month for regular workers, three months for executives, supervisors, technicians, and similar staff.  If the termination is for anything other than gross negligence, theft, or intentional damage to company property, a severance payment must be made.

Employees contribute 5.5% of their salary to social security; employers contribute 16%.  Employers also pay a 3% payroll tax.
